I wouldn't allow it if the Homunculus Servant was not actively engaged in combat with the enemy AND occupying a different space. The enemy needs to know it is there and view it as a threat or it isn't serving as a proper distraction for the sneak attack, imo.

Tiny Servant also requires a bonus action to command, so you aren't losing out on action economy. There's some RAI debate about whether or not a homunculus servant has arms, but the text indicates you choose its appearance and there isn't any conditional that limits its scope of actions (see Simic Hybrid / Thri Keen arms for reference).

Whether most/all DMs would rule that a Homunculus Servant could attune to magic items or not I can't say but the rules for Attunement make no specific mention of Player Characters. They don't even specify creature type. They just specify creature. Individual magic items might be more specific but the base attunement rules only specify creature.
